Participant Waiver
Effective Sept 1st, 2020, all active and participating CWPC members must sign the updated electronic waiver (below) in order to participate in all upcoming practices and tournaments. Members who have previously signed this waiver will need to read the liability wavier again including the new COVID-19 Waiver posted below. By signing our electronic waiver you are agreeing to both the original CWPC liability waiver and to the additional content found in the Waiver and Release of Liability as to COVID-19 ONLY text found below. 

Waiver and Release of Liability as to COVID-19 ONLY

Your safety and wellness are of vital importance to Cleveland Water Polo Club, Inc. (the “Company”). The Company has taken measures and precautions recommended by the Centers for Disease Control and Prevention (CDC) and the Ohio Department of Health to ensure your safety while utilizing our facilities, programs, events, or activities. However, even with the additional measures and precautions and despite our best efforts, the novel coronavirus (“COVID-19”) may remain present, including among asymptomatic persons, and capable of infecting you and other individuals. Therefore, the Company requires that you acknowledge and agree as follows:

·       I understand the hazards of COVID-19 and I am familiar with the CDC guidelines regarding COVID-19. I acknowledge and understand that the circumstances regarding COVID-19 are changing from day to day and that, accordingly, the CDC guidelines are regularly modified and updated and I accept full responsibility for familiarizing myself with the most recent updates.

 

·       Knowing this information, I, for myself, my child(ren), my spouse, my legal representatives, heirs, and assigns, hereby voluntarily elect to utilize the Company’s facilities and/or participate in the Company’s programs, events, or activities and I hereby agree to accept and assume any and all risks of COVID-19 to me, my child(ren), my spouse, my legal representatives, heirs, and assigns.

·       I, for myself, my child(ren), my spouse, my legal representatives, heirs, and assigns, hereby perpetually and irrevocably WAIVE, RELEASE AND DISCHARGE the Company, its owners, officers, and employees from any and all liability relating to the contraction of COVID-19 which may hereafter accrue to me, my child(ren), my spouse, my legal representatives, heirs, and assigns, as a direct or indirect result of my or my child(ren)’s use of the Company’s facilities or as a result of my or my child(ren)’s participation in the Company’s programs, events, or activities.

 

·       I, for myself, my child(ren), my spouse, my legal representatives, heirs and assigns, hereby agree to indemnify and hold harmless the Company, its owners, officers and employees, from any and all claims of any nature, including all costs, expenses and attorney’s fees, which may in any manner result from or arise out of my or my child(ren)’s use of the Company’s facilities or participation in the Company’s programs, events, or activities.

I, the undersigned, affirm that I am at least 18 years of age and am freely signing this agreement or that I am signing on behalf of a minor child that I have the legal authority to sign such agreements on behalf of.
